1. Overview

These Terms of Service (“Terms”) govern your use of Zoey Voice AI, including all features, tools, automations, call handling functionality, website widget interactions, usage-based processing, and services provided through zoeyvoice.ai (“Service”).

By creating an account, subscribing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. Description of Service

Zoey Voice AI is a cloud-based Software-as-a-Service (SaaS) platform that provides:

Primary Services

  • Inbound call handling using AI voice agents
  • Outbound calling for follow-ups and outreach
  • Website widget conversations (Smart Website Widget)

Supporting Features (Supplementary)

  • SMS and email follow-up
  • Appointment booking
  • CRM logging
  • Additional automations

Zoey Voice AI is not a human call center or receptionist service. It is an AI-powered communication tool.

3. Account Registration

To use the Service, you must:

  • Provide accurate registration information
  • Maintain an active payment method
  • Be at least 18 years old
  • Use the Service only for lawful purposes

You are responsible for all activity conducted under your account.

4. Fees, Billing, and Payment Terms

4.1 Subscription & Setup Fees

The Service includes a monthly subscription fee, a setup fee, and may include promotional pricing. Your receipt or agreement will list standard pricing, promotional pricing, promo duration, and renewal pricing.

4.2 Usage-Based Billing (Per Minute)

Zoey Voice AI charges a per-minute processing fee billed per second. Usage includes AI call handling, AI processing, and website widget conversations.
Usage fees are not refundable under any circumstances.

4.3 Automatic Monthly Billing

By using the Service, you authorize Safira LLC to automatically bill your payment method monthly for subscription fees and usage fees. Charges may appear as “Zoey Voice AI” or “zoeyvoice.ai”. Payments are processed through Stripe or PayPal.

4.4 Failure of Payment

If payment fails, Safira may suspend or terminate your account until a valid payment method is provided.

4.5 No Refund Policy

  • No refunds for subscription fees
  • No refunds for usage fees
  • No refunds for pre-purchased minutes
  • No refunds for downtime or service interruptions

4.6 Exceptions — Catastrophic Failure

Safira LLC may issue a partial refund of subscription fees only if a catastrophic failure caused entirely by Safira makes the Service unusable for an extended period.

5. Customer Responsibilities

5.1 Legal Compliance (TCPA, Consent)

You are responsible for complying with all applicable laws, including TCPA, FCC regulations, and call recording consent laws.

5.2 Accuracy of Business Information

You are responsible for the accuracy of business information, instructions, scripts, and schedules provided to Zoey Voice AI.

5.3 Prohibited Uses

  • Unlawful communications
  • Spam or unsolicited messaging
  • Harassment or abuse
  • Violations of privacy laws

6. AI Output Disclaimer

Zoey Voice AI uses artificial intelligence. While we use best efforts and extensive testing, you acknowledge that:

  • AI responses may not always be accurate
  • Transcriptions may contain errors
  • Scheduling or messaging errors may occur
  • Noise, accents, or ambiguous speech may affect performance

Safira LLC is not liable for missed leads, lost opportunities, scheduling errors, or business impacts due to AI limitations.

7. Data Storage & Retention

By using the Service, you authorize Safira LLC to store and process:

  • Call recordings
  • Call transcripts
  • Chat transcripts
  • Contact records
  • Appointment and booking data
  • Usage analytics

Data may be reviewed for quality assurance, system improvements, and customer support.

8. Third-Party Services

The Service may rely on GoHighLevel, Stripe, PayPal, telephony carriers, and AI processing systems. Safira LLC is not responsible for outages or failures caused by third-party services.

9. Service Availability & Downtime

Downtime may occur due to maintenance, internet issues, telephony outages, or events outside Safira’s control. Downtime does not entitle you to refunds except as described in Section 4.6.

10. Indemnification

You agree to indemnify and hold harmless Safira LLC from all claims arising from your use of the Service, violations of TCPA, misuse of recordings, unlawful communications, or inaccuracies in your business information.

11. Limitation of Liability

Safira LLC’s total liability is limited to the amount you paid for one month of subscription fees.

Safira LLC is not liable for indirect, incidental, consequential, or punitive damages, including lost revenue or missed opportunities.

12. Term, Cancellation & Termination

12.1 Term

Your subscription renews monthly until canceled.

12.2 Cancellation

Cancellation must be received within 7 days of the upcoming billing date. No refunds for partial months.

12.3 Termination by Safira

Safira LLC may suspend or terminate access for nonpayment, illegal activity, misuse, or violations of these Terms.

13. Modifications to Terms

Safira LLC may update these Terms at any time. Continued use of the Service constitutes acceptance of updated Terms.

14. Governing Law

These Terms are governed by the laws of the State of California.

15. Notices

Notices will be sent to the email associated with your account.

16. Entire Agreement

These Terms constitute the entire agreement between you and Safira LLC regarding the Service and supersede all prior agreements.
